Township ordered to pay Robyn Mulcahy $25,000 in costs
Tay Valley Township’s Superior Court application against the operator of Blueberry Creek Nature Centre has been dismissed with prejudice, with the township ordered to pay $25,000 in costs.
Justice B. Abrams issued the consent order on Aug. 18 in the case involving Robyn Mulcahy, who runs the Blueberry Creek Nature Centre, also known as Blueberry Creek Forest School.
The order states that the court heard oral submissions from the parties on April 23 and subsequently received their consent.
“This court orders that the application by Tay Valley Township … against Robyn Mulcahy … is dismissed with prejudice,” the order states.
The court further ordered the Township to pay Mulcahy $25,000 in costs.
A dismissal with prejudice brings the application to a final conclusion and prevents the same claim from being brought again.
The order does not contain findings on the merits of the township’s allegations against Mulcahy or provide reasons for the parties’ agreement to dismiss the application.
Hometown News has asked Tay Valley Township why it consented to the dismissal, why it agreed to the $25,000 costs payment and how much the township has spent in total on the court proceeding.
The township has also been asked whether the order resolves all outstanding matters involving Blueberry Creek Nature Centre and whether it intends to pursue any further enforcement action.
Mulcahy has also been contacted for comment.
