OLT releases the list of issues set to be reviewed regarding proposed subdivision

The Ontario Land Tribunal (OLT) has released the list of issues identified by the involved parties tied to the proposed subdivision by CAIVAN at the Perth Golf Course.

This came when the OLT recently issued a Memorandum of Oral Decision, following the Case Management Conference (CMC) that took place on Feb. 12, 2024. The CMC was related to the appeal submitted by CAIVAN (Perth GC) Limited (Case Number OLT-23-000534) for its proposed subdivision within the Town of Perth.

The Memorandum provides clarity for next steps and the topics that will be covered during the hearing. The document includes timelines for the OLT procedural order, the order of evidence and the issues list. The issues list includes concerns brought forth by all parties, and their relevance will be determined at the upcoming hearing by matter of evidence and/or argument. The issues identified fall under several categories, including:

  • Planning Issues (including demands on infrastructure and public facilities);
  • Transportation Issues (including access/egress);
  • Stormwater Management Issues;
  • Natural Hazards Issues (including potential impacts of the Tay River and Grant’s Creek floodplains);
  • Zoning Amendment Issues; and
  • Draft Plan of Subdivision Issues
  • The Memorandum of Oral Decision is available at Perth.ca/Planning (please note: Attachment 2 has been removed as it contains personal contact information for a number of citizens).

A four-week OLT video hearing will take place from Monday, Aug. 19-Friday, Sept. 13, 2024. Members of the public are welcome to attend the hearing and can join virtually or by telephone at 1-888-299-1889 (Access code: 943-363-669). Note that the Tribunal will not be sitting on Monday, Sept. 2 and Monday, Sept. 9.

The Town will continue to provide information to the public relating to this OLT hearing as it becomes available, through the Town’s website and social media. As the matter is now one of a legal capacity, Town staff and Council are not able to provide comment on the case.
